Measures for buildings with special requirements for earthquake zones.

The Chamber of Deputies and the Senate of the Republic have approved; THE PRESIDENT OF THE REPUBLIC

promulgate the following law:

Title 1
General provisions

Art. 1 - Type of structures and technical standards In all the municipalities of the Republic, both public and private buildings must be built in compliance with the technical standards concerning the various construction elements that will be established with subsequent decrees by the Minister for Public Works, in concert with the Minister for the Interior, having heard the Superior Council of Public Works, which will also draw on the collaboration of the National Research Council. These decrees must be issued within one year of the entry into force of this law. The technical standards referred to in the previous paragraph may be subsequently amended or updated with the same procedure whenever necessary. These rules will address the following topics:

a) general technical-constructive criteria for the design, execution and construction of masonry buildings and for their consolidation;

b) loads and overloads and their combinations, also according to the type and construction methods and the destination of the work; general criteria for the verification of construction safety;

c) surveys on land and rocks, stability of natural slopes and slopes, general criteria and technical specifications for the design, execution and testing of the support works of the land and foundation works;

d) general criteria and technical specifications for the design, execution and testing of special works, such as bridges, dams, tanks, pipes, towers, prefabricated buildings in general, aqueducts, sewers;

e) protection of buildings from fires. If construction systems other than masonry or with a load-bearing framework of normal and pre-stressed reinforced concrete, steel or combined systems of the aforementioned materials are used, for buildings with four or more storeys inside and outside, the suitability of such systems must be proven by a declaration issued by the president of the Board of Public Works on a consistent opinion of the same council.

Art. 2 - Inhabitants to be consolidated In all the municipal territories or parts thereof, in which the State or the Region intervened or intervened for consolidation works in accordance with the law of 9 July 1908, n. 445 and subsequent modifications and additions, no work and no work, except those of ordinary maintenance and finishing, can be carried out without the prior authorization of the technical office of the Region or of the civil engineering office according to the competences in force. Consolidation works, in cases of urgency recognized by order of the mayor, can exceptionally be undertaken even before the aforementioned authorization, which in any case must be requested within five days from the beginning of the works. An appeal against the application for authorization is allowed, respectively, to the president of the regional council or to the regional administrator for public works, which decide by definitive provision. Art. 3 - Disciplinary works and degrees of seismicity All buildings whose safety may in any case affect public safety, to be carried out in areas declared as seismic according to the second paragraph letter a) of this article, are governed, as well as by the regulations to the previous art. 1, by specific technical standards that will be issued with subsequent decrees by the Minister for Public Works, in concert with the Minister for the Interior, after hearing the Superior Council for Public Works, which will also make use of the National Research Council, within six months from the entry into force of this law and updated with the same procedure whenever necessary in relation to the progress of knowledge of seismic phenomena. With decrees of the Minister for Public Works issued in agreement with the Minister for the Interior, after hearing the Supreme Council of Public Works and the Regions concerned, on the basis of proven technical motivations, the following are provided:

a) updating the lists of the areas declared as seismic for the purposes of this law and the provisions previously issued;

b) to attribute to the seismic zones different values ​​of the degree of seismicity to be taken as a basis for the determination of seismic actions and anything else specified by technical standards;

c) to the possible necessary updating of the lists of seismic zones and of the values ​​attributed to the seismicity levels. The decrees referred to in letters a) and b) of the preceding paragraph shall be issued within six months of the entry into force of this law.

Art. 4 - Content of technical standards The technical standards referred to in the previous art. 3, to be adopted on the basis of the general criteria indicated in the following articles and according to the different degrees of seismicity, will concern:

a) the maximum height of buildings in relation to the building system, the degree of seismicity of the area and the road widths;

b) the minimum distances allowed between buildings and junctions between adjacent buildings;

c) the horizontal and vertical seismic actions to be taken into account in the size of the elements of the constructions and their junctions;

d) the sizing and verification of the different parts of the buildings;

e) the construction types for foundations and elevated parts. The general characteristics and the physical-mechanical properties of the foundation soils, ie the soils constituting the subsoil up to the depth at which the tensions induced by the structure assume significant values ​​for the deformation and stability of the land, must be thoroughly verified. For buildings on slopes the assessments must be conveniently extended outside the building area to detect all the factors necessary to evaluate the stability conditions of the slopes themselves. The technical standards referred to in the first paragraph may determine the extent of the assessments according to the morphology and nature of the land and the degree of seismicity.

Art. 5 - Constructive systems Buildings can be constructed with:

a) framed structure in normal or prestressed reinforced concrete, steel or combined systems of the aforesaid materials;

b) structure with load-bearing panels;

c) masonry structure;

d) timber structure.

Art. 6 - Masonry buildings Masonry constructions are those in which the masonry has a load-bearing function. They must show adequate solidarity characteristics between the structural elements that compose them and of overall stiffness according to the indications of the technical standards referred to in the previous art. 3.

Art. 7 - Buildings with a load-bearing structure The structures formed with load-bearing panels are those formed with the association of prefabricated vertical panels (walls), of a height equal to one level and of a width of more than one meter, made integral with horizontal structures (floors) prefabricated or built in situ. The structures with load-bearing panels must be made of solid concrete or lightened, simple, reinforced normal or pre-compressed, have joints made with concrete or cement mortar, and be stiffened by appropriate bracing, consisting of the same vertical panels overlapped or concrete slabs made in-situ; the bracing must be oriented at least according to two distinct directions. The box-like complex consisting of the panels must create a static organism capable of absorbing the seismic actions referred to in art. 9. The transmission of mutual actions between the various elements must be ensured by metal reinforcements. The suitability of such construction systems, also in function of the degree of seismicity, must be proven by a declaration issued by the president of the Superior Council of Public Works, on the basis of the opinion of the same Council.

Art. 8 - Buildings with framed structures We mean for framed structures those constituted by rectilinear or curvilinear rods, however bound together and externally. These may include irrigation elements consisting of:

(a) cross-linked steel structures, normal or precompressed reinforced concrete;

b) steel wall elements, normal or prestressed reinforced concrete. The irrigation elements must be appropriately connected to the framework of the construction so that the transmission of the seismic actions to the stiffeners is ensured. The resistant complex must be proportioned so as to absorb the seismic actions defined by the technical standards referred to in art. 3. The curtain walls of the framed structures must be effectively connected to the rods of the structure according to the methods specified by the technical standards referred to in the previous art. 3.

Art. 9 - Seismic actions The building must be designed and constructed in such a way as to be able to withstand vertical and horizontal actions, the twisting and tilting moments indicated respectively in the following letters a), b), c) and d) and defined from the technical standards referred to in the previous art. 3

a) vertical actions: generally, vertical seismic actions are not taken into account; for structures of great light or of particular importance, to the effects of these actions, an appropriate theoretical or experimental dynamic analysis must take place;

b) horizontal actions: horizontal seismic actions are schematised through the introduction of two horizontal force systems acting not simultaneously in two orthogonal directions;

c) torques: on every floor the torque due to the horizontal forces acting on the upper floors must be considered and in any case no less than the values ​​to be determined according to the indications given by the technical standards referred to in the previous art. 3;

d) overturning moments: for the verification of the pillars and foundations the normal efforts caused by the overturning effect of the horizontal seismic actions must be evaluated according to the indications of the technical standards referred to in the previous art. 3.

Art. 10 -Verification of the structures The analysis of the stresses due to the seismic actions referred to in the previous one

article is made taking into account the distribution of these among the resistant elements of the entire structure. These resistant elements must be verified for the possible combinations of the seismic effects with all the other external actions, without any reduction of the overloads, but with the exclusion of the wind action.

Art. 11 - Verification of foundations The stability calculations of the foundation soil-foundation complex are carried out with the methods and procedures of geotechnics, taking into account, among the acting forces, the horizontal seismic actions applied to the construction and evaluated as specified by the standards techniques referred to in the previous art. 3.

Art. 12 - Derogations Derogations may be granted for compliance with the technical standards referred to in the previous art. 3 by the Minister for Public Works following a preliminary investigation by the competent peripheral office of the Ministry of Public Works and favorable opinion of the Superior Council of Public Works, when there are particular reasons, which prevent it in full or in part the observance, due to the need to safeguard the environmental characteristics of historic centers. These exemptions must be provided for in the detailed plans.

Art. 13 - Opinion of the sections to state competence of the civil engineering offices on town planning instruments. All the municipalities in which the norms referred to in Title II of this law and those referred to in the previous art. 2, must request the opinion of the sections to state competence of the competent civil engineering office on general planning and detailed planning before the adoption resolution, as well as on the subdivisions agreed before the approval resolution, and their variants for the purpose of verifying the compatibility of the respective forecasts with the geomorphological conditions of the territory. The sections to state competence of the offices of civil engineering must be pronounced within sixty days of receipt of the request of the municipal administration. Chapter II Repairs and elevations
